MINUTES
OF THE HARDYSTON TOWNSHIP COUNCIL MEETING HELD ON OCTOBER
3, 2000
The meeting
was called to order by Mayor Ross at 7:00 P.M. with the opening
statement that the meeting had been duly advertised and met
all the requirements of the Sunshine Law. Also present were:
Councilman Kievit, Councilman Lasinski, Councilman Worflar,
Manager John Eskilson and Clerk Louanne Cular.

A motion
was made by Worflar to approve the consent agenda, seconded
by Kievit. All in favor. Motion carried.
ORDINANCES
1st READING: ORDINANCE 2000-18
AN ORDINANCE
AMENDING CHAPTER 185, ZONIING, OF THE CODE OF THE TOWNSHIP
OF HARDYSTON
BE IT
ORDAINED by the Township Council of the Township of Hardyston
that Chapter 185, Zoning, of the Code of the Township of Hardyston
is hereby amended as follows:
1. Section
185-58, Specific conditions for conditional uses, subsection
Z.
Towers and Antennas, shall be amended to include a new section
(2)(I) as follows:
Maximum
height: 140 feet, except that where more than one set of commercial
transmitting/receiving antennas are located on a tower, the
total height of the tower shall not be greater than 198 feet.
This shall be measured as the overall height including antennas.
2. Section
185-58, Specific conditions for conditional uses, subsection
Z. Towers and Antennas,
section (4) General requirements for towers and antennas,
subsection c, Facility abandonment shall
be amended to read
Facility
abandonment. In the event that any tower is abandoned or not
operated for a period of one year, the same shall be removed
within 60 days notice by the Township, at the sole expense
of the owner. Owner shall notify the Township of its intent
to abandon use of its tower at least 90 days prior to cessation
of use. The owner shall provide a performance bond and/or
other assurances satisfactory to the appropriate land use
board and Township Council that will cause antennas, the supporting
tower, the ancillary building enclosing related electronic
equipment and other related improvements to the land to be
removed at no cost to the Township.
3. Section
185-58, Specific conditions for conditional uses, subsection
Z. Towers and Antennas,
section (4) General requirements for towers and antennas,
subsection g. be amended to add a new
section [6] as follows:
[6] How
the proposed location relates to the overall objective of
minimizing visual impact including, but not limited to, a
submission on the use of stealth tower structures.
A motion
was made by Kievit to approve Ordinance 2000-18 on first reading,
seconded by Worflar. All in favor. Motion carried.

AMUSEMENT LICENSE RENEWAL: A motion was made by Lasinski
to approve the amusement license renewal for J & J Family
Restaurant, seconded by Kievit. All in favor. Motion carried.
C.
APPOINTMENT - HARDYSTON TOWNSHIP ELEMENTARY SCHOOL STEERING
COMMITTEE - TOWNSHIP LIAISON - A motion was made by Kievit
to appoint Leslie Hamilton, seconded by Worflar. All in favor.
Motion carried.

PARTICIPATION: A motion was made and seconded to open
the meeting to the public. All in favor. Motion carried. The
