MINUTES OF THE HARDYSTON TOWNSHIP COUNCIL MEETING HELD ON MARCH 7, 2000.

The meeting was called to order by Mayor Ross at 7:00 P.M. with the opening statement that the meeting had been duly advertised and met all the requirements of the Sunshine Law. Also present were: Councilman Kievit, , Councilman Worflar, Councilwoman Hamilton, Manager John Eskilson and Clerk Louanne Cular.

INTRODUCTION OF THE 2000 MUNICIPAL BUDGET - A motion was made by Kievit to introduce the 2000 municipal budget, seconded by Hamilton. All in favor. Motion carried. A copy of the full budget may be found at the end of these miutes.

CONSENT AGENDA: ALL MATTERS LISTED BELOW ARE CONSIDERED TO BE ROUTINE IN NATURE AND WILL BE ENACTED BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THE ITEMS. IF ANY DISCUSSION IS DESIRED, THAT PARTICULAR ITEM WILL BE REMOVED FROM THE CONSENT AGENDA AND WILL BE CONSIDERED SEPARATELY.

ORDINANCES: ORDINANCE 2000-6
1st READING: BOND ORDINANCE PROVIDING FOR VARIOUS
CAPITAL IMPROVEMENTS IN AND FOR THE
TOWNSHIP OF HARDYSTON AND
APPROPRIATING THE AGGREGATE AMOUNT OF
$980,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $931,000 BONDS OR NOTES OF THE TOWNSHIP FOR THE FINANCING OF THE COST
THEREOF AND PROVIDING FOR THE DOWN PAYMENT FOR SAID
MINUTES OF THE HARDYSTON TOWNSHIP COUNCIL MEETING HELD ON MARCH 7, 2000.

A motion was made by Worflar to approve Ordinance 2000-6 on first reading, seconded by Hamilton. All in favor. Motion carried.

ORDINANCES: ORDINANCE 2000-01
2ND READING: ORDINANCE ACCEPTING DONATION OF LAND
FROM: (LISTED IN ORDINANCE)

A motion was made by Worflar to approve Ordinance 2000-01 on first reading, seconded by Kievit. Roll Call: Ross-no, Kievit-no, Hamilton-no, Worflar-no. Motion denied.

ORDINANCE 2000-02
AN ORDINANCE OF THE TOWNSHIP COUNCIL
OF THE TOWNSHIP OF HARDYSTON AMENDING
CHAPTER XVI OF THE LAND USE CODE OF THE
TOWNSHIP ENTITLED "SITE PLAN REVIEW"

A motion was made by Kievit to approve Ordinance 2000-02 on second reading, seconded by Worflar. Motion made and seconded to open the meeting to the public. No public participation. Motion made and seconded to close to the public. All in favor. Motion carried.

ORDINANCE 2000-03
AN ORDINANCE TO APPROVE AND ADOPT MAPS
OF THE AREA OR AREAS IN HARDYSTON
TOWNSHIP THAT ARE WITHIN 1,000 FEET OF ANY
PROPERTY USED FOR SCHOOL PURPOSES.

A motion was made by Kievit to approve Ordinance 2000-03 on second reading, seconded by Hamilton. Motion made and seconded to open the meeting to the public. The public asked questions regarding the replacement of signs. Motion made and seconded to close to the public. All in favor. Motion carried.

ORDINANCE 2000-04
A MUNICIPAL ORDINANCE PROHIBITING
POLITICAL FUNDRAISING ON OR BY USE
OF PUBLIC PROPERTY.

A motion was made by Worflar to approve Ordinance 2000-04 on second reading with a minor correction to include a sentence eliminated in the process of scanning the document, seconded by Hamilton. Motion made and seconded to open the meeting to the public. The public asked questions regarding municipal owned property. Present were William Weightman and a representative of the League of Women Voters. Motion made and seconded to close to the public. All in favor. Motion carried.

ORDINANCE 2000-05
AN ORDINANCE TO AMEND CHAPTER XIX OF THE GENERAL ORDINANCES OF THE TOWNSHIP OF HARDYSTON, ENTITLED, "FEES".

A motion was made by Kievit to approve Ordinance 2000-05 on second reading, seconded by Worflar. Motion made and seconded to open the meeting to the public. No public participation. Motion made and seconded to close to the public. All in favor. Motion carried.


NEW BUSINESS:

A. Tax Collectors Resolution :

#1. WHEREAS, there appears on the tax records of the Township of Hardyston certain residents who have a tax overpayment; and

WHEREAS, the Collector of Taxes recommends the refund of such overpayments be made;

NOW, THEREFORE , BE IT RESOLVED that the proper officers be and they are hereby authorized to issue checks refunding such overpayments as hereafter shown

A motion was made by Kievit to approve the resolutions as presented, seconded by Worflar. All in favor. Motion carried.

B. Tax Assessor Resolution - Authorization to defend tax appeals: BE IT RESOLVED by the governing body of the Township of Hardyston that the Municipal Assessor and Municipal Attorney be and they are hereby authorized to defend before the Sussex County Board of Taxation and Tax Court of the State of New Jersey all contested appeals and to initiate municipal appeals to correct the Township of Hardyston tax list including but not limited to rollback complaints, added and omitted assessment complaints and such other appeals as are necessary to correct the assessments for the Township of Hardyston; and

BE IT FURTHER RESOLVED that the Municipal Assessor and Municipal Attorney be and are hereby designated as the agents of the Township of Hardyston for the purpose of signing settlements of the foregoing matters by stipulation.

BE IT FURTHER RESOLVED that governing body authorization shall be required for stipulation resulting in the reduction of annual taxes by $5,000 or more or for stipulations resulting in a 50% or greater reduction in assessed value.

A motion was made by Worflar to approve the resolutions as presented, seconded by Kievit. All in favor. Motion carried.

C. Resolution - Sussex County Strategic Growth Plan Support By Hardyston Township: . WHEREAS, the New Jersey Department of Community Affairs has made a $300,000.00 grant available to the Sussex County Strategic Growth Advisory Committee to conduct research and prepare a Strategic Growth Plan and vision for Sussex County; and

WHEREAS, this Committee has met, prepared and submitted a grant application to the DCA for approval; and

WHEREAS, this application outlines data that will be compiled, both in written and Geographic Information System format, which will ultimately be available for the county and its municipalities; and

WHEREAS, this Strategic Growth Plan will assist all Sussex County municipalities with their long range planning efforts by providing build out analysis, carrying capacity analysis and fiscal analysis; and

WHEREAS, the New Jersey Department of Community Affairs should be provided with evidence that Sussex County municipalities support the receipt of this grant and the information it will provide to all Sussex County citizens.

NOW THEREFORE BE IT RESOLVED, that the Township/Borough of Hardyston supports this Strategic Growth Planning effort made possible through a grant from the New Jersey Department of Community Affairs; and

BE IT FURTHER RESOLVED that the Township/ Borough of Hardyston looks forward to participation in this process through the public meeting process set up by the Strategic Growth Advisory Committee.

A motion was made by Kievit to approve the resolutions as presented, seconded by Worflar. All in favor. Motion carried.

D. Resolution authorizing the Township Manager to execute the agreements with Borough of Franklin and Public Defender: BE IT RESOLVED by the Township Council of the Township of Hardyston that the Township Manager is hereby authorized to execute the following contracts/leases/agreements:

1. Interlocal Service Agreement with the Borough of Franklin - Recreation Services
2. Professional Service Agreement with James A. Sloan - Municipal Public Defender

A motion was made by Hamilton to approve the resolutions as presented, seconded by Kievit. All in favor. Motion carried.

PUBLIC PARTICIPATION: A motion was made and seconded to open the meeting to the public. All in favor. Motion carried. Public commented on the upcoming Heritage Society annual meeting to be held April 30th.
