OF THE HARDYSTON TOWNSHIP COUNCIL MEETING HELD ON MARCH 21,
2000.
The meeting
was called to order by Mayor Ross at 7:00 P.M. with the opening
statement that the meeting had been duly advertised and met
all the requirements of the Sunshine Law. Also present were:
Councilman Kievit, , Councilman Lasinski, Councilman Worflar,
Councilwoman Hamilton, Manager John Eskilson and Clerk Louanne
Cular.

1st READING: ORDINANCE 2000-7
AN ORDINANCE TO AMEND CHAPTER 4, POLICE
REGUATIONS, SECTION 4-3.5, FALSE ALARMS,
AND SECTION 4-3.6, VIOLATIONS AND PENALTIES,
OF THE REVISED GENERAL ORDINANCES OF THE
TOWNSHIP OF HARDYSTON.
BE IT
ORDAINED by the Township Council of the Township of Hardyston
that Chapter 4, Police Regulations, Section 4-3.5, False Alarms,
and Section 4-3.6, Violations and Penalties, of the Revised
General Ordinances of the Township of Hardyston be amended
in its entirety as follows:
4-3.5
False Alarms
a. False
alarms shall be considered a violation of the provisions of
this section. In case of false alarm, any person having knowledge
thereof shall immediately notify the police department. The
police department shall cause an investigation to be made
of all false alarms and shall keep a record of such false
alarms on file. the police department shall issue written
warnings for the first four false alarms on any registered
system occurring within the same calendar year. Subsequent
false alarms shall be subject to the penalties provider for
below.
4-3.6
Violations and Penalties. Any person who shall violate any
of the terms or provisions of this section or who shall commit
or do any act or thing prohibited by this section shall, upon
conviction thereof, be punished in accordance with Chapter
4, section 4-6 provided that minimum fines shall be established
as follows:

A.
1999 Budget Transfer Resolution
WHEREAS,
VARIOUS 1999 bills have been presented for payment this year
which were not covered by order number and/or recorded at
the time of transfers in the 1999 budget in the last two months
of 1999 and
WHEREAS,
NJS 40A:4-59 provides that all unexpended balances carried
forward after the close of year are available until lapsed
at the close of the succeeding year to meet specific claims,
commitments or contracts incurred during the preceding fiscal
year; and allows transfers to be made from unexpended balances
which are expected to be insufficient during the first three
months of the succeeding year;
NOW, THEREFORE,
BE IT RESOLVED by the Council of the Township of Hardyston
that the following transfers in the amount of $1000.00 be
made between the 1999 Budget Appropriation Reserves as follows:

B.
RESOLUTION URGING THE PRESIDENT OF THE UNITED STATES TO RELEASE
OIL FROM THE STRATEGIC PETROLEUM RESERVE
WHEREAS,
the Township of Hardyston is dependent upon petroleum based
products to provide basic services such as police/fire protection
and road repair/maintenance to its residents; and
WHEREAS,
the cost of diesel fuel and gasoline to the Township has more
than doubled in the past twelve months; and
WHEREAS,
as a result of this increase the Township of Hardyston has
been forced to drastically increase the amount of funds budgeted
for the purchase of diesel fuel and gasoline; and
WHEREAS,
the increase in the cost of fuel to the Township has had a
direct impact on the amount of property taxes to be raised
in support of the municipal budget; and
WHEREAS,
the exorbitant increase in fuel prices has, and will continue
to have, a devastating effect on families and individuals
on fixed or limited incomes; and
WHEREAS,
in 1975, as an emergency response to the Arab oil embargo
of 1973, the Congress of the United States created the Strategic
Petroleum Reserve in order to protect the nation from future
disruptions in oil supply; and
WHEREAS,
on October 24, 1992 the President of the United States signed
into law the Energy Policy Act of 1992 which allowed for the
draw down of the Strategic Petroleum Reserves in emergency
situations involving a severe price increase likely to cause
a major adverse impact on the nation's economy; and
WHEREAS,
the Hardyston Township Council believes the current dramatic
increase in fuel prices and its impact on all sectors of the
economy including business, government and families qualifies
as an emergency situation under the Energy Policy Act of 1992.
NOW THEREFORE
BE IT RESOLVED by the Township Council of the Township of
Hardyston that it hereby urges the President of the United
States to immediately release oil supplies from the nation's
Strategic Petroleum Reserve in an effort to stabilize and
reduce the cost of petroleum products in the United States;
and
BE IT
FURTHER RESOLVED that the Township Council urges the President
and the Congress to enact policies which promote alternative
sources of energy to reduce the nation's dependence on petroleum;
and
BE IT
FURTHER RESOLVED that copies of this Resolution be forwarded
to the President of the United States, the Honorable Robert
Toricelli - United States Senate, the Honorable Frank Lautenberg
- United States Senate, the Honorable Marge Roukema - United
States Congress 5th District, the Honorable Christine Todd
Whitman - Governor of the State of New Jersey, the New Jersey
League of Municipalities, all Sussex County Municipalities.

D. RESOLUTION ADOPTING A POLICE MANUAL FOR THE HARDYSTON TOWNSHIP
POLICE DEPARTMENT: BE IT RESOLVED by the Township Council
of the Township of Hardyston that it hereby adopts the Hardyston
Police Department Police Manual dated March 21, 2000.

TO BE PAID: A motion was made by Kievit to pay the bills
as presented, with the addition of Aramark Uniform for $317.00,
seconded by Worflar. All in favor with Ross abstaining. Motion

PUBLIC
PARTICIPATION: A motion was made and seconded to open
the meeting to the public. All in favor. Motion carried. The
public commented on the Circus at the Littell Community Center,
Silver Grove Road Bridge, Rock Lodge Road Bridge and Ordinance
on False Alarms.
